Turbaned Property systems and its disputes

The turban system has been in operation since before the establishment of Pakistan and is still in use in many cities, including Karachi and Hyderabad.

Owner hands over his property to buyer for 60% or more and receives a nominal monthly rent. The fare in different areas of the city is a minimum of Rs 100 and a maximum of Rs 5,000.

However, despite this agreement, the owner of the property does not change, while the tenant can give the property to someone else at a higher price and rent, but is obliged to pay 10% of the additional amount to the owner.

On the other hand, the owner can sell his property to someone with the knowledge of the same tenant, as a result of which the tenant remains the same and the owner changes.

People associated with the turban system say that there was a time when the properties used under the turban system did not have such value and importance that the parties adhered to the previous agreements, but now shops, flats and warehouses in the city center.

Prices have reached crores of rupees and the owners want to vacate their properties as they have received good offers from the builder.

He said the process is not easy because the property is passed on to many people and the amount of turbans has multiplied, as well as the value of the shops due to decades of business reputation. Due to which the people sitting on the turban are not ready to vacate and even if they are ready, differences arise due to disagreement over the amount.
